The terms for checking your own record.

These Terms govern your use of MyCheck — the consumer service that lets an individual in Canada request a Canadian criminal record check about themselves and receive the result electronically. Business and organizational use is covered by our separate Terms of Service.

These MyCheck Terms of Service (the “Terms”) govern your use of MyCheck, a consumer service provided by Credibled Inc. (“Credibled”, “we”, “us” or “our”) that lets an individual request a Canadian criminal record check about themselves. By using MyCheck, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use MyCheck.

These Terms apply to individual consumers using MyCheck. Business and organizational use of Credibled’s services is governed by our separate Terms of Service, not by these Terms.

1. What MyCheck is

MyCheck lets you request a Canadian criminal record check about yourself and receive the result electronically. MyCheck is offered only in Canada and only for Canadian criminal record checks. It is not available outside Canada and does not provide other types of background or identity checks. MyCheck is for your personal use.

MyCheck does not provide legal advice. A criminal record check result is a record from official or authorized sources and is not an assessment of your character, suitability, or eligibility for any purpose.

2. Eligibility

To use MyCheck, you must:

  • be a resident of Canada;
  • be at least 18 years old, or the age of majority in your province or territory of residence;
  • be requesting a check about yourself, and not about any other person; and
  • provide accurate, complete, and current information about yourself.

You may not use MyCheck to request a check about another person, or on behalf of an employer or organization. If you need a check for employment or organizational screening, that is a separate service governed by our business Terms of Service.

3. Your consent and authorization

By submitting a request through MyCheck, you confirm that the check is about you, and you authorize Credibled and its screening providers and authorized record sources to collect, use, and disclose your personal information as necessary to obtain and deliver your Canadian criminal record check result. You confirm that the information you provide is true and relates to you.

You may withdraw your consent and cancel your request at any time before processing begins by contacting us at [email protected]. Once processing has begun, the check may already be underway and withdrawal may no longer be possible.

4. Identity verification

Because a criminal record check involves sensitive personal information about you, identity verification is mandatory. We verify your identity using a third-party identity verification provider before we process your request or release your result. You agree to provide the identity information we reasonably require, and you understand that we may decline or delay a request if we cannot verify that you are the person the check concerns.

5. How you receive your result

We deliver your result to you electronically, as a PDF document sent to the email address you provide when you make your request. You are responsible for providing an accurate email address, for the security of that email account, and for keeping your result confidential once you receive it. Because your result contains sensitive personal information about you, you should access it only on a device and email account you control, and delete or securely store the PDF once you have it.

We rely on information provided by official or authorized record sources. We do not guarantee the accuracy, completeness, or timeliness of the information contained in a result, and we are not responsible for errors or omissions in the underlying source records. If you believe your result is inaccurate or incomplete, see Section 9.

6. Fees, payment, and refunds

Fees for a MyCheck request are shown before you submit your request and are payable in advance. Payment is processed by our third-party payment provider, Stripe, and is subject to Stripe’s terms and privacy policy. We do not store your full payment card details.

Processing of a criminal record check typically begins promptly after you submit a request. If a check cannot be completed, if there is a problem with your request that is not attributable to you, or where a refund is otherwise appropriate or required by applicable consumer protection law, we will provide a refund or credit for the affected portion of the fee. We review refund requests reasonably and on a case-by-case basis, consistent with the consumer protection law of your province or territory of residence.

Nothing in this Section limits any refund or cancellation right you have that cannot be waived under applicable consumer protection law. To request a refund, contact us at [email protected].

7. Your privacy

For MyCheck, you are both our customer and the individual the personal information is about. Credibled determines the purposes and means of processing your personal information for MyCheck and acts as the party responsible for it (a controller) under the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy law, including, for Quebec residents, the Act respecting the protection of personal information in the private sector.

We collect and use your personal information only to provide the check you requested, to verify your identity, to process payment, and as otherwise described in our Privacy Policy. We do not sell your personal information. We retain your personal information only as long as necessary to provide the service and to meet our legal obligations, after which we securely delete or de-identify it.

You may request access to, correction of, or deletion of your personal information by contacting [email protected], subject to any records we are required by law to retain. We rely on service providers, including our payment provider and screening and record-source providers, to deliver MyCheck. A current list of the subprocessors we use is available on request, subject to a confidentiality or non-disclosure agreement, through our Trust page at credibled.com/trust.

8. Data location

Personal information processed through MyCheck is hosted in Canada by default. Where any personal information is processed by a service provider or record source outside your province, including outside Quebec for Quebec residents, we take steps consistent with applicable privacy law to confirm that it will receive an adequate level of protection.

9. Disputes, corrections, and deletion

If you wish to dispute a result, correct information about you, or request deletion of information we hold about you, you may contact us at [email protected]. We will handle your request in accordance with applicable privacy law. Where a result is based on records from an official or authorized source, some corrections may need to be made through that source, and we will provide reasonable assistance in directing you.

10. Acceptable use

You agree not to:

  • use MyCheck for any unlawful purpose or in violation of any applicable law;
  • request a check about anyone other than yourself, or misrepresent your identity;
  • provide false, misleading, or fraudulent information;
  • attempt to gain unauthorized access to MyCheck or interfere with its operation or security;
  • use automated means to access MyCheck without our prior written consent; or
  • copy, modify, reverse-engineer, or create derivative works from MyCheck.

We may suspend or terminate your access to MyCheck if you breach these Terms.

11. Intellectual property

MyCheck and its content are owned by Credibled. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use MyCheck for your personal, non-commercial use only. All rights not expressly granted are reserved.

12. Disclaimer of warranties

MyCheck is provided “as is” and “as available.” To the extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that MyCheck will be uninterrupted or error-free. Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under applicable consumer protection law.

13. Limitation of liability

To the maximum extent permitted by law, Credibled will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of MyCheck. Our total liability to you for any claim relating to MyCheck will not exceed the amount you paid for the applicable check.

Nothing in these Terms excludes or limits our liability for gross negligence, fraud, or willful misconduct, or any liability or consumer right that cannot be excluded or limited under the consumer protection law of your province or territory of residence.

14. Termination

We may suspend or terminate your access to MyCheck at any time if you breach these Terms or applicable law, or where necessary for security or legal reasons. If we terminate your access without cause and you have paid for a check we have not yet performed, we will provide a refund for the unperformed portion in accordance with applicable law.

15. Governing law and your provincial rights

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. This does not deprive you of the protection of mandatory consumer protection or privacy laws of the province or territory in which you reside. If you reside in Quebec, your rights under Quebec consumer protection and privacy law continue to apply.

16. Changes to these Terms

We may update these Terms from time to time by posting the updated version. Substantive changes will be notified before they take effect where required by law. Your continued use of MyCheck after the changes take effect constitutes acceptance of the updated Terms.

17. Electronic communications

You consent to receive notices and communications from us electronically, including by email or through MyCheck. Such communications satisfy any legal requirement that they be in writing. You may withdraw this consent by contacting us, though doing so may affect your ability to use MyCheck.
